| Abstract: | Článek se zabývá rozborem jednotlivých zákonných ustanovení, která neplatnost a neúčinnost právních jednání v poměrech insolvenčního řízení upravují, rozborem předpokladů těchto právních institutů a jejich náležitostí. S ohledem na toto své specifické zaměření se téma zabývá i jinými souvisejícími oblastmi, jako jsou např. konkrétní důsledky prohlášení neplatnosti či neúčinnosti právního úkonu ve vztahu k věřitelům a insolvenčnímu řízení obecně, procesní aspekty dané problematiky, tj. odpůrčí žaloba a následné vedení incidenčního sporu apod. |
| Abstract in different language: | The article deals with the analysis of individual statutory provisions regulating the nullity and ineffectiveness of legal proceedings in insolvency proceedings, the analysis of the prerequisites of these legal institutes and their requirements. Due to this specific focus, the topic also deals with other related areas, such as the specific consequences of a declaration of nullity or ineffectiveness of a legal proceedings in relation to creditors and insolvency proceedings in general, procedural aspects of the issue, i.e. counterclaim and subsequent litigation, etc. |
