| Abstract: | Cílem této práce je přehledná kompilace dosavadního zpracování procesněprávní problematiky účastníků řízení, to z historického hlediska, dále obsáhnutí nejdůležitějších institutů k tématu současného účastenství v civilním procesu. Primárním objektem mé práce jsou účastníci civilního řízení. V jednotlivých kapitolách se autor věnuje nejprve historickým souvislostem účastenství. V následujících kapitolách je šířeji pojednáno o subjektech civilního řízení, vymezení samotných účastníků řízení, procesních institutů hlavní a vedlejší intervence, přistoupení, záměny a procesního nástupnictví. Vymezení procesních úkonů, jejichž prostřednictvím účastníci vykonávají svou činnost po celou dobu řízení a jimiž přispívají k dosažení jeho účelu, rovněž úzce souvisí se zvoleným tématem. V závěrečné části diplomové práce je možno nalézt komparaci české právní úpravy účastenství s právní úpravou téhož v Rakousku. Rakouská právní úprava se jeví jako vhodné comparandum z hlediska historického kontextu, v jehož světle vychází současná česká i rakouská právní úprava ze stejné tradice Rakouska-Uherska. |
| Abstract in different language: | This thesis is dealing with the topic of ?Participants in an adversarial and nonadversarial proceeding?. The parties to the dispute represent a cornerstone to any civil procedure. Without the parties, there would likely be no court procedure at all. The civil procedure can be defined as a body of law that sets out the procedure rules for courts, dispute parties and other subjects, while defence to breached or threatened subjective rights and lawful interests is provided. This thesis focuses on the currently effective legal framework applicable in the Czech Republic. The primary source of law is the Civil Procedure Code, which has gone though several novelizations reflecting the historical-political changes and current needs of the legal practice. The primary objective of this thesis is ? as the title might suggest ? the parties to the dispute in either disputed and undisputed procedures. The thesis offers a scope into the historical consequences of procedure participation from the very beginning of the civil procedure itself up to its present form. It also comprises a general overview of other procedurally involved subjects, e.g. courts, prosecutor?s office and others. Furthermore, it delineates the necessary conditions for a person to appear at a court as a procedural party in order to execute its related procedural rights and acts. The following chapters concern the procedural law bodies that are related to the procedural participation. It is important to note, all procedure institutes are described according the currently effective legal framework. In addition, I also decided to comprise into this thesis some of the most important procedural acts, since they practically represent the way for participants to conduct the course of a court procedure ? from its very beginning up to a final decision. At the conclusion of this thesis, I am offering a glimpse at the effective legal regulation of participation in Austria. It was Austria that appeared to be most suitable for comparison, since the Czech and Austrian legal culture originates ? given to the common past history - from the same bases and traditions. |
